General Terms and Conditions (GTC)

§ 1 Scope

For all orders placed via our online shop eichenkraftshop.com, these General Terms and Conditions (GTC) apply exclusively to consumers within the meaning of § 13 BGB and entrepreneurs within the meaning of § 14 BGB. The provider is Newkers GmbH, Kramerkoppel 40, DE-22041 Hamburg.

§ 2 Contracting Party

The purchase contract is concluded with Newkers GmbH, Kramerkoppel 40, DE-22041 Hamburg, registered in the commercial register of the district court of Hamburg under HRB 196599.

§ 3 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order. By clicking the order button, you place a binding order for the goods contained in your shopping cart. We accept your order by sending an order confirmation via email or by delivering the goods within two days.

§ 4 Prices and Shipping Costs

All prices include statutory value-added tax. In addition to the stated prices, we charge a flat shipping fee for delivery within Germany, according to our shipping conditions.

§ 5 Delivery

Delivery is only made within the delivery regions specified by us. Deliveries to packing stations are possible. The estimated delivery time is 2–5 working days after receipt of payment.

§ 6 Payment

Payment can be made by credit card, PayPal, Klarna, SEPA direct debit, or other methods offered in the shop.

§ 7 Retention of Title

The goods remain our property until full payment has been received.

§ 8 Right of Withdrawal

Consumers have a right of withdrawal in accordance with our cancellation policy.

§ 9 Liability for Defects

Statutory liability for defects applies.

§ 10 Information on Biocidal Products

Several of our products are biocidal products within the meaning of Regulation (EU) No. 528/2012. Before each use, observe the information on the label and in the product information. Use biocidal products carefully.

§ 11 Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies insofar as the granted protection is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
